Age Discrimination

Age discrimination is potentially the most far-reaching type of discrimination because everyone has an age! Unless the successful candidate is the same age as the unsuccessful ones, the unsuccessful candidates can claim that they didn’t get the job or the promotion because either they were too young or they were too old!

Potentially, age discrimination is a no-win situation for employers. Fortunately, most employers instinctively avoid direct discrimination, such as advertising for someone ‘ideally age 35-45’. However, there is almost unlimited scope for indirect discrimination, such as requiring ‘10 years’ relevant work experience’, which no one under age 26 can have!
