Disciplinary Procedures

Most employers have disciplinary rules and manage disciplinary issues by using formal disciplinary procedures. These procedures often cover verbal warnings, written warnings and dismissal but could also include suspension or demotion as a disciplinary penalty.

There is currently a Statutory Dispute Resolution Procedure covering disciplinary procedures, and a failure to follow the statutory procedure will lead to a finding of an automatically unfair dismissal at an Employment Tribunal and will normally result in any tribunal award being increased by between 10% and 50%. A statutory Code of Practice, drawn up by Acas, will soon replace the current statutory rules, and a failure to follow this statutory code will result in any tribunal award being increased by up to 25%.
