Contracts of Employment
Employment terms and conditions were usually incorporated into a contract of employment,
which was often very long, very wordy and full of legalese.
These days, many employers use a statement of initial employment particulars – the
basic employment contract – supplemented by an
Employee Handbook or Staff Handbook. Many employers, however, do not realise
that employment terms can become contractual even if they are not contained in a
‘contract of employment’. A memo on a notice board referring to “the traditional
Christmas bonus” can result in an implied contractual term that there will be a
Christmas bonus. Unlike a commercial contract, contractual employment terms do not
even have to be in writing and, for example, a verbal offer of employment, or of
overtime pay, etc. can form a binding contract even though it is made verbally.
