Holiday Entitlement

All UK workers now have the statutory right to paid holidays. The statutory minimum holidays are currently 4.8 weeks a year (including any bank holidays or public holidays that are taken), increasing to 5.6 weeks from 6 April 2009.

There are ‘fall-back’ rules for the notice required to request, grant or refuse a holiday and there are special rules for calculating the entitlement for someone who joins during the employer’s holiday year and for the taking of holidays during the first year of service.

Workers have a statutory entitlement to pay in lieu of any unused holidays when their employment ends, but many employers do not realise that there is no corresponding statutory entitlement for employers to recoup pay for any holidays that have been ‘over-taken’. Recouping pay for ‘over-taken’ holiday is a matter of contract, and without a correctly worded employment contract, employers will be unable to make a holiday pay deduction.
