This week a tribunal ruled a senior member of staff had been unfairly dismissed because his employer had failed to follow a ‘reasonable procedure’. This was despite the tribunal rejecting the claimants age discrimination claim.

Are you confident you are following reasonable procedures when it comes to dismissal?

If you have an employee going through the dismissal process you need to ensure you document everything and have treated your employee fairly. In the unfortunate case you are taken to tribunal you need to be able to prove the following:

  • There was a valid reason for dismissal e.g. redundancy, capability
  • You have acted fairly
  • You explained to the employee why you are carrying out this process
  • Proper investigations were carried out
  • Relevant procedures were followed
  • You gave your employee the right to appeal.
