The guidance recommends that elements of the internship should be agreed in writing, such as learning objectives, with the intern’s activities tailored to meet these learning objectives. Documenting objectives and recording that ‘out of pocket’ expenses will be repaid will not, in itself, amount to an employment contract entitling the individual to the NMW, and this information may be useful as evidence if their entitlement to the NMW is challenged at a future date.
