Age Discrimination
Age discrimination is potentially the most far-reaching type of discrimination because
everyone has an age! Unless the successful candidate is the same age as the unsuccessful
ones, the unsuccessful candidates can claim that they didn’t get the job or the
promotion because they were either too young or too old!
Potentially, age discrimination is a no-win situation for employers. Fortunately,
most employers instinctively avoid direct discrimination, such as advertising for
someone ‘ideally age 35-45’. However, there is almost unlimited scope for indirect
discrimination, such as requiring ‘10 years’ relevant work experience’, which no
one under age 26 can have! Citationion is highly experienced in formulating non-discriminatory practices and
has successfully defended a client in one of the UK’s first age discrimination Employment
Tribunal cases.
