Once the plans are implemented, reservists will not need to have been employed for more than two years before they can bring a claim alleging unfair dismissal for being (or planning to become) a reservist, and companies that discriminate in this way will therefore be more open to action at an employment tribunal. The government is however stopping short of making it unlawful to discriminate against reservists when recruiting, although this issue is being kept under review, and legislation could be included in a 2015 Armed Forces Bill if necessary.
