Costly breach of Agency Workers Regulations

The Watford Tribunal determined that Barnet LBC had failed to provide information on the number of agency workers it employed when services were transferred and redundancies were made, breaching the Agency Workers Regulations 2010 (AWR). The Employment Judge in the case described the Council’s refusal to provide information as “a relatively serious failure” and the Tribunal made protective awards of 60 days’ pay and compensatory awards of 40 and 50 days’ pay in respect of a redundancy exercise and two transfers.
