Enterprise and Regulatory Reform Act 2013 coming into force

For any tribunal claim presented on or after 25th October 2013, if an employment tribunal concludes that the employer has breached a worker’s rights, and considers that the breach has any “aggravating factor”, it may order the employer to pay a penalty to the Secretary of State of 50% of the award (minimum £100, maximum £5,000). The penalty is halved if paid within 21 days of the tribunal’s decision being sent to the employer.
